Terms of purchase and sale
I. General provisions
- The rules of Getnosun.com online store (hereinafter – the Store) (hereinafter – the Rules) apply to the Customer when placing an order and purchasing goods in the Store of getnosun.com, UAB “Modern home solutions”, UAB, company code 305712741, VAT taxpayer code LT100013977918, registration address Raitininkų g. 4-197, Vilnius, Lithuania, the data of which is collected and stored in the Register of Legal Entities of the Republic of Lithuania (hereinafter – Getnosun.com or the Vendor).
- Getnosun.com has the right to change the Shop Rules. When the Customer makes a purchase in the Shop, the Rules in force at the time of placing the order shall apply.
- The Customer shall not be given the opportunity to place an order for goods in the Getnosun.com Shop if he/she is not familiar with the Terms and Conditions of the Shop. In all cases, the Customer shall be deemed to have read and accepted the Terms and Conditions if, prior to ordering the goods, the Customer confirms his/her acceptance of the Terms and Conditions by clicking on “I AGREE”. In cases where the Customer does not accept all or part of the Terms and Conditions in part or in full, he/she must not place the order electronically with Getnosun.com, otherwise the Customer shall be deemed to have read and accepted all of the Shop’s Terms and Conditions unconditionally.
- Getnosun.com shall be exempt from any liability in cases where losses or other undesirable consequences arise as a result of the Customer’s failure to read the Terms and Conditions of the Shop, notwithstanding the advice given to him and his obligations, even though he was given the opportunity to do so.
II. Privacy policy
- If the Customer wishes to receive Getnosun.com’s information notifications, the Customer shall be given the opportunity to opt-in to receive such notifications.
- A cookie is a small text file that is sent to and temporarily stored on the device of each person who visits the website from which the website is accessed. The information collected by cookies on the website helps to identify the visitor to the website, to store the history of the visit to the website and to adapt the content accordingly. Cookies on the Getnosun.com website are for:
- Ensuring the full functionality of the website
- Ensure shopping cart functionality
- Remind me about the items I like
- Collect statistics on page visits
To delete all cookies stored on your computer, please refer to the manufacturer’s instructions for the browser you are using, which can be found by clicking on “Help” in the browser menu.

- When ordering the goods, the Customer shall provide the personal data of the Customer necessary for the conclusion of the contract for the purchase and sale of the goods (hereinafter referred to as the “Contract” or the “Purchase and Sale Contract”) and for the delivery of the goods: first name; last name; residential address (if requested), the address to which the goods will be delivered; telephone number; any other necessary data required on the order form. Getnosun.com confirms that such data will be used exclusively for the purpose of the execution of the Contract and delivery of the goods and undertakes not to disclose such information to any third party, other than Getnosun.com’s partners providing delivery or other services related to the placement or execution of the Customer’s order. Any other exceptions to the disclosure of the Customer’s personal information to third parties shall in all cases be agreed with the Customer. In all other cases, any disclosure of Customer’s personal information to third parties may only be made in the cases provided for by the laws of the Republic of Lithuania.
- By registering in the Getnosun.com Shop and ordering goods, the Customer undertakes to protect and not to disclose his/her login data to anyone. By registering, the Customer confirms that he/she is of legal age and has the right to order goods from the Getnosun.com Shop. In the event that the Customer discloses his/her login details, Getnosun.com shall be exempt from any and all liability and/or possible loss incurred by the Customer in connection therewith. All actions performed using the Customer’s login credentials shall be deemed to have been performed by the Customer and the Customer assumes all responsibility for actions performed using his/her login credentials.
- The Customer is fully responsible for the accuracy of the data provided in his/her registration form and/or order form.
- By reading the Terms and Conditions, the Customer confirms that he/she is aware that cookies will be placed on his/her computer when browsing the Getnosun.com Shop.
III. Ordering procedure and conditions
- The customer visits the Shop’s website and selects the products he/she likes. On the basis of his/her choice, a shopping cart is formed.
- Once the shopping cart has been created, the Customer shall enter the data necessary for the conclusion of the Purchase and Sale Agreement between Getnosun.com and the Customer and for the delivery of the goods selected by the Customer: his/her name, surname, residential address (if requested), the address to which the goods are to be delivered, telephone number and any additional information which may be relevant for the conclusion of the Agreement and the delivery of the goods ordered.
- Next, the Customer must choose one of the available payment methods in the Getnosun.com Shop (see Section V of the Terms and Conditions).
- The next step is to select the delivery method from the available Getnosun.com delivery options.
- The last window generates all the data provided by the Customer, which the Customer must verify as correct before confirming. The Customer shall have the opportunity to correct the incorrect data before the order is sent to Getnosun.com The Customer shall not be given the opportunity to confirm the order until he/she has entered all the data required for the conclusion of the Contract and has indicated that he/she has read and accepts the Getnosun.com Shop Terms and Conditions. In the event that the Customer has not read the Shop Rules prior to selecting the goods, the Customer must do so prior to confirming his/her order and the data contained therein.
- Once the customer confirms the order by clicking “CONFIRM ORDER”, it is sent to Getnosun.com. The order is deemed to have been placed from the moment it is received by Getnosun.com. At the same time, a Purchase and Sale Agreement shall be deemed to have been concluded between the Customer and Getnosun.com from that moment. However, Getnosun.com’s obligation to perform the Contract arises only from the moment Playpadel.com receives confirmation from the bank of the Customer’s choice of payment for the selected goods.
- After the Customer has placed an order, the Getnosun.com system automatically sends the Customer an e-mail containing the ordered goods and the Customer’s data.
- When Getnosun.com receives a notification from the bank that the Customer has made a payment order and has paid for the ordered goods, a notification is sent to the Customer’s e-mail address. The moment of receipt of the notification from the bank shall be deemed to be the moment of commencement of Getnosun.com’s obligation to perform the Contract concluded with the Customer.
- The order placed by the Customer shall be stored in the Getnosun.com database in accordance with the requirements of the applicable legislation of the Republic of Lithuania regarding the retention period of such data.
- In all cases, the Customer shall be deemed to have read and unconditionally accepted all the Terms and Conditions of the Shop, as well as all other terms and conditions attached to the order, by placing the order.
- The Contract shall be concluded and executed in the Lithuanian language and shall be subject to the laws of the Republic of Lithuania and the jurisdiction of the Lithuanian courts.
IV. Warranties and pricing of goods
The characteristics of each item are generally indicated next to each item in the Shop.
- Getnosun.com states, and the Customer acknowledges, that he/she is aware that the colour, shape or other parameters of the goods displayed in the Shop may not correspond to the actual size, shape and colour of the goods due to the characteristics of the monitor used.
- The Customer agrees that when placing an order electronically in the Shop, the Customer shall pay the price indicated in the order.
- Prices in the Shop and on the order form are quoted in the official national currency including VAT. The price quoted does not include the delivery charge payable by the Customer, which shall be indicated at the time of placing the order.
- Getnosun.com sells goods that meet the conditions set out in the order. In the event that the goods handed over to the Customer do not comply with certain requirements of the order, the Customer agrees to first notify Getnosun.com immediately by telephone or email, and Getnosun.com undertakes to take all steps to remedy the existing defects, provided that such defects are caused by the fault of Getnosun.com or of any third parties acting on its behalf. If Getnosun.com fails to remedy the deficiencies within a reasonable period of time agreed with the Customer, the Customer shall have the right to assert his/her rights in accordance with the procedure provided for in the Civil Code of the Republic of Lithuania.
V. Payment procedures and deadlines
- The Customer shall pay for the goods ordered and the delivery price indicated in the Getnosun.com Shop in one of the following ways: by bank transfer, by using his/her online bank or by credit card. Getnosun.com reserves the right to change the payment methods.
- The Customer undertakes to pay for the ordered goods and the delivery of the goods immediately. The delivery period shall commence only upon receipt of payment.
VI. Return of goods
- The customer is given the option to return goods they do not like.
- The Customer may exercise this right within 14 calendar days from the moment of confirmation of the order. This right of the Customer shall be based on the Customer’s dissatisfaction with the dimensions, shape, colour, model or the completeness of the goods concerned.
- Returns are only possible if the returned goods meet the following requirements:
(a) have not been used;
(b) have not been damaged;
(c) the preservation of the consumer characteristics of the goods;
(d) has not lost its marketable appearance.
- Alterations to the packaging necessary for the inspection of the goods are not considered to be material damage or loss of merchantable appearance. In all cases, goods must be returned in their original packaging.
- When returning the goods to the Getnosun.com Shop, the Customer must present the documents of purchase.
- Returns shall be made by the Customer submitting a request to info@modernusnamai.lt stating what is to be returned and the reason for the return, and by sending the items to the Seller Getnosun.com or by handing them over to the physical Getnosun.com store. The risk of damage to the goods shall be borne by the Customer until delivery of the returned goods to the Seller.
- The customer will be refunded the amount paid, excluding the delivery cost.
- Goods may only be returned if they comply with the requirements set out in paragraph 3 of this Part of the Regulations. The refund shall be made no later than 14 days after delivery of the returned items to the Seller.
- In the event that the goods purchased by the buyer are defective in quality, the buyer’s claims against the seller in respect of defects in quality may be brought within the 2-year guarantee period, i.e. the buyer has the right to claim from the seller, at his option, within the 2-year guarantee period:
1) have the defects repaired (fixed) free of charge;
2. replace the faulty item with one of good quality free of charge;
3) reduce the price of the goods; or
4) unilaterally terminate the contract and demand reimbursement of the price paid for the goods (Article 6.363(7) of the Civil Code).
- Warranty in case of manufacturing defect – 2 years.
VII. Delivery of goods
- Getnosun.com undertakes to aim to deliver the Goods to the Customer no later than 5 working days after the confirmation of the order has been sent to the Customer. This time limit does not apply in cases where Getnosun.com does not have the goods in stock and the Customer is informed of a shortage of the goods ordered. At the same time, the Customer agrees that in exceptional cases the delivery of goods may be delayed due to unforeseen circumstances. In such a case, Getnosun.com undertakes to contact the Customer immediately to agree on the delivery of the goods.
- The Customer undertakes to specify the place of delivery when ordering the goods.
- Goods ordered in the Getnosun.com online shop are delivered by an authorised courier service (for information, please see the “Delivery” section of the Shop).
- If, due to the Customer’s fault or circumstances beyond the Customer’s control, the authorised courier service is unable to deliver the goods, the courier service shall additionally agree a new delivery time suitable for the Customer. Re-delivery shall not be made more than twice. If the Customer fails to accept the goods three times, the goods shall be returned to Getnosun.com and the Customer shall not be entitled to claim for failure to deliver the goods on time. In addition, Getnosun.com shall in all cases be exempt from liability for breach of delivery deadlines if the goods are not delivered to the Customer or are not delivered on time due to the Customer’s fault or due to circumstances beyond the Customer’s control.
- The Customer must immediately inform Getnosun.lt by e-mail if the parcel is delivered in damaged, broken or otherwise damaged packaging; as well as in cases when the parcel contains goods not ordered or the wrong quantity of such goods, an incomplete set of goods, goods of the wrong size, dimensions.
- In all cases where the packaging of the consignment is wrinkled, wet or otherwise externally damaged upon delivery of the goods by the courier to the Customer, the Customer shall be obliged to indicate (comment on) or draw up a separate document in respect of any such defects in the courier’s acknowledgement of delivery. The Customer must do this in the presence of the courier. Failure to do so shall relieve Getnosun.com from liability to the Customer for damage to the goods, provided that such damage was caused by packaging damage not noted by the Customer in the delivery note.
- In cases when upon receipt of the goods the Customer notices that the consignment does not contain the right set of goods or the goods are not of the right size, colour or other dimensions, are damaged or do not correspond to the merchantable appearance – the Customer must immediately inform Getnosun.com by e-mail info@modernusnamai.lt by providing photos of the goods.
VIII. Other provisions
- All notifications to Getnosun.com must be made by email to info@modernusnamai.lt .
- The contract between the Client and Getnosun.com shall be concluded and executed in the official Lithuanian language, shall be subject to the legislation of the Republic of Lithuania and the jurisdiction of the Lithuanian courts.
